REGULATIONS FOR THE DEVICE AND THE ACTIVITY OF THE SCIENTIFIC RESEARCH SECTOR

AT THE UNIVERSITY OF RUSE "ANGEL KANCHEV"

 

Chapter one.

Basics, Structure and management

Art. 1. (1) The Scientific Research Sector (SRS) is a service unit of the University of Ruse "Angel Kanchev".

(2) SRS is not a legal entity, does not have and is not developing its own material base, and its activity is within the framework of academic structures and units.

(3) The subject of the activity of the SRS is the organization and administration of the research and scientific-applied activities of the University of Ruse.

(4) SRS reports its activities annually to the Academic Council.

(5) The name of the Research Sector in English is "Research and Development Centre". It is also permissible to use the abbreviation "R&D Centre".

Art. 2. The activity of SRS is carried out by its administrative and management team.

Art. 3. The structure of SRS covers: units, laboratories and temporary collectives managed by administrative management.

Art. 4. (1) The governing bodies of SRS are: Management Board (Board) and Director of SRS.

(2) The director of the SRS is elected by the Academic Council on the proposal of the Rector.

(3) Candidates for members of the Board of Directors are nominated by the faculty councils according to quotas determined by the current Board of Directors, according to the share of the relevant faculties in the executed contracts and research projects during the mandate.

(4) The numerical composition of the Management Board of SRS does not exceed 9 members, and they are approved by the Academic Council with a mandate coinciding with the mandate of the General Assembly of the  University of Ruse.

(5) The Chairman of the Management Board of SRS is the Director.

(6) The meetings of the Board of Directors of SRS are held in person, remotely or in a hybrid form. They are legal if 2/3 of its members are present, less those absent due to illness and those abroad. Decisions are made by a simple majority of those present.

(7) Meetings of the SRS Board of Directors are convened by its Chairman or at the request of not less than 1/3 of its members.

Art. 5. (1) The director of SRS has the following functions and powers:

1. Represents SRS before the University of Ruse and before third parties, according to the job description;

2. Organizes and supervises the implementation of the decisions of the Board of Directors of SRS;

3. Creates conditions for effective management of the activity of NIS, in accordance with the current market relations and legal framework.

4. Performs other functions assigned by the governing bodies of the university.

(2) If necessary, at the proposal of the Director, the Rector may appoint Deputy. director. His responsibilities and powers are determined by the Director in agreement with the Rector.

Art. 6. The Management Board of SRS has the following functions and powers:

1. Discusses quarterly and annual reports on the activity of SRS;

2. Discusses and proposes for adoption and approval by the Academic Council amendments to the Regulations for the structure and activity of SRS;

3. Periodically hears information about the concluded projects and contracts, as well as about the activities of the units of the SRS; controls their implementation and the management of their deductions.

4. Proposes creation, reorganization and termination of specialized units at SRS for approval by the Academic Council.

5. Proposes for acceptance by the Academic Council amendments to the deductions from the SRS contracts and approval by the Rector.

6. Proposes for adoption by the Academic Council changes in the deductions of the units to the SRS.

7. Performs an information-coordinating function in the operational reporting of projects of a scientific and scientific-applied nature, according to the requirements of the relevant operational governing body.

8. When considering issues and problems related to a given unit, include in the agenda of the meeting a hearing of the head of the unit.

Chapter two.

Activity of SRS

Art. 7. (1) SRS carries out the administrative service of business and consulting contracts with legal entities and individuals, which includes:

1. Prepares the conclusion of contracts with third parties (including contractors);

2. Conclusion of civil contracts with the manager and with the members of the collectives responsible for the implementation of the contracts, which regulate their rights and obligations;

3. Controlling the admissibility of costs under the contracts;

4. Separate analytical accounting records are kept for each contract;

5. Management of deductions from contracts, the amount and distribution of which are determined by the Academic Council;

6. For deductions to other units of the university (if such are provided for), separate analytical accounting records are kept.

(2) The head of the temporary collective:

1. Represents the team when concluding the contract;

2. Organizes and directs the activities of the team during the execution of the contract;

3. Disposes of the financial resources granted to him through the contract and is responsible for the expediency of their expenditure;

4. Accepts the results of the work of individual team members and determines their remuneration.

5. Contract managers are responsible for the correctness of the concluded contracts (terms, obligations, performance conditions) and the timely conclusion of the necessary additional agreements.

(3) The financial and accounting service of the contracts is carried out by the Financial and Accounting Department of the University of Ruse.

(4) When the Director of NIS or the head of the contract discovers damages (as a result of a gross violation of the regulations in force; in case of weak control and admission of violations by the members of the team; when causing damage to Ruse University property; in case of abuse of trust of the management of NIS or the University of Ruse; in the case of actions damaging the good name of the University of Rousse), the guilty persons are liable according to the general rules of (LC, LOC and PC) and the Law on Administrative Violations and Penalties.

Art. 8. (1) The scientific research sector performs the administrative service of the units of the NIS, which includes:

1. Controlling the eligibility of expenses;

2. Assistance in communication with other units and departments of the University of Ruse;

3. Management of internal requests to the units, according to a regulation additionally approved by the Academic Council;

4. Management of deductions from the units, according to a regulation approved in advance by the Academic Council, on the proposal of the Management Board of SRS.

(2) The financial and accounting services of the units are carried out by the Financial and Accounting Department of the University of Ruse.

(3) The Academic Council approves the current structure of SRS.

Art. 9. (1) SRS supports the administrative service during and 5 years after the completion of research projects under national and international programs of the University of Ruse, which includes:

1. Assistance in communication with the program operator;

2. Assistance in communication with other units and departments of the University of Ruse;

3. Maintenance and provision of standard documents for project work;

4. Management of overhead deductions from the projects on the basis of an allocation protocol approved by the Director of SRS, the chief accountant of the University of Ruse and the project manager.

5. Archiving and storage of completed research projects.

(2) Financial and accounting services for research projects are carried out by the Financial and Accounting Department of the University of Ruse.

Art. 10 SRS carries out the information service of the research activity of the University of Ruse, which includes:

1. Maintenance of a database with up-to-date information on all scientific and scientific-applied projects and contracts of the University of Ruse;

2. Collection and storage of information on the activities of the units of the SRS;

3. Support information platform of SRS;

4. Preparation of reports on the project and economic activity of the University of Ruse.

Transitional and final provisions

§1. This regulation was adopted at the meeting of the Academic Council on 25th October, 2022 and cancels all previous acts and decisions that refer to the structure and activity of SRS, and the registration under BULSTAT is subject to termination, starting from 01st January,2023. The current financial year is completed according to the previous order.

§2. The management bodies of SRS, elected before the adoption of these Regulations, continue to perform their functions until the expiration of the mandate of the General Assembly of the University.

§3. Contracts entered into prior to the approval of the Regulations and the SRS Contract Deduction Scheme (Appendix 1) will be terminated under the conditions under which they were concluded or according to the Deduction Scheme according to the preferences of the contract manager.

§4. The implementation of the Regulations is entrusted to the Director of SRS.

§5. The regulations enter into force from 25th October, 2022.
